A trademark is a sign capable of distinguishing the goods or services of one enterprise from those of others. It can be a word, logo, symbol, slogan, sound, or even a color combination. Trademarks help build brand identity and consumer trust, and legal registration provides exclusive rights and remedies against infringement.
Any individual, company, partnership firm, trust, or society can apply for a trademark in India, even before starting their business (on a proposed-to-be-used basis). Foreign applicants can also apply under the Madrid Protocol or directly in India, subject to reciprocity.
If there are no objections or oppositions, a trademark can be registered in 6–12 months. However, if there are objections by the Registry or opposition from third parties, it may take 2–3 years or more. Once registered, the trademark is valid for 10 years, renewable indefinitely.
A registered trademark owner has the exclusive right to use the mark for the goods/services it is registered under, and to prevent others from using a confusingly similar mark. The owner can also license, assign, or enforce the trademark through legal action.
